Terms & Conditions
Welcome to Abayty (the “App”), operated by Cork Holding. These Terms and Conditions (“Terms”) govern your use of our App and the services provided through it. By accessing or using the App, you agree to be bound by these Terms, which form a legally binding electronic contract under Bahraini law. If you do not agree with any part of these Terms, please do not use the App.
1. Use of the App
1.1. You must be at least 18 years old or have the consent of your parents or legal guardian to use this App.
1.2. You agree to use the App only for lawful purposes and in accordance with these Terms.
1.3. You are responsible for maintaining the confidentiality of your account and password, and for restricting access to your device. You accept responsibility for all activities that occur under your account.
1.4. Prohibited Conduct: You agree not to:
- Violate any applicable laws or regulations when using the App.
- Post or transmit any content that is unlawful, harmful, offensive, or that infringes others’ rights.
- Impersonate any person or entity or misrepresent your identity or affiliation.
- Attempt to interfere with or disrupt the App’s functionality or security (for example, by introducing viruses or hacking).
- Engage in any fraudulent or harmful activity toward other users, our business, or the App.
2. Custom Orders
2.1. Our App allows you to design and order custom-made Abayas. You are responsible for providing accurate measurements, preferences, and design specifications for your custom order.
2.2. Once a custom order is confirmed and payment is received, it cannot be modified or canceled by you due to the personalized nature of the product.
2.3. Due to the personalized nature of the product, no returns or exchanges are accepted unless the item is defective or does not match your confirmed order specifications.
2.4. If you receive a defective or incorrect item, please notify us within 15 days of delivery to arrange for a replacement or full refund at no additional cost to you, in accordance with applicable consumer protection laws.
3. Payments
3.1. All prices for products are listed in Bahraini Dinars (BHD) and are subject to change without prior notice.
3.2. Payment must be made in full at the time of placing an order. We accept various payment methods (e.g., credit or debit cards) through secure third-party payment providers.
3.3. In case of any payment disputes or issues, please contact our support team promptly. We will work with you and, if necessary, with the payment provider to resolve the issue.
4. Shipping and Delivery
4.1. Delivery times provided are estimates and may vary due to unforeseen circumstances.
4.2. We are not responsible for delivery delays caused by events beyond our control, such as courier delays, customs processing, or force majeure events.
4.3. Shipping costs, taxes, and any applicable duties will be calculated and disclosed to you during checkout.
4.4. If delivery of your order is delayed by more than 15 days beyond the estimated date (and no alternate timeframe was agreed upon), you may cancel the order and receive a full refund.
5. Intellectual Property
5.1. All content and materials available on the App (including, but not limited to, designs, text, graphics, logos, and images) are our property or are licensed to us, and are protected by intellectual property laws.
5.2. You may not copy, modify, distribute, or reproduce any part of the App’s content without our prior written consent.
6. User Content
6.1. If you upload or submit any content to the App (such as custom designs, measurements, or other materials for your order), you retain ownership of that content. However, by submitting it, you grant us a non-exclusive, royalty-free license to use, reproduce, and modify your content as needed to fulfill your order and operate our services.
6.2. You warrant that your User Content does not infringe any third-party rights and does not violate any laws or regulations.
6.3. We reserve the right to refuse or remove any User Content that violates these Terms or any applicable law.
7. Limitation of Liability
We strive to provide a great service, but we make no guarantees or warranties of any kind (express or implied) regarding the accuracy, completeness, or availability of the App or its content. Your use of the App and our services is at your own risk. To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential losses or damages arising out of or in connection with your use of the App or any products purchased through it. Nothing in these Terms is intended to limit or exclude any legal rights you have as a consumer under Bahraini law, and we do not seek to limit our liability beyond what is permitted by applicable law.
8. Termination
We reserve the right to suspend or terminate your access to the App at our sole discretion, with or without prior notice, if you violate these Terms or engage in conduct that is harmful to us or other users. Upon termination, your right to use the App will cease immediately.
9. Privacy Policy
Please review our Privacy Policy to understand how we collect, use, and protect your personal information. By using the App, you acknowledge that your personal data may be collected and processed as described in our Privacy Policy.
10. Governing Law
These Terms and any disputes arising from or related to your use of the App are governed by the laws of the Kingdom of Bahrain. You agree that any dispute or claim arising out of these Terms or your use of the App will be subject to the exclusive jurisdiction of the courts of the Kingdom of Bahrain.
11. Changes to These Terms
We may update or modify these Terms from time to time. If we make material changes, we will notify users through the App or via the contact information you have provided. Your continued use of the App after any changes to the Terms constitutes your acceptance of the updated Terms.
